Is BIM mandatory for your public contract?

Answer a few questions to find out whether Italy's Public Contracts Code requires digital information management, which threshold applies and what your tender documents must include.

Question 1 of 7

Who is launching the procedure?

Informative guidance, not legal advice. Source: art. 43 and Annex I.9 D.Lgs. 36/2023, text in force on 6 Nov 2026.

Since 1 January 2025, article 43 of Italy's Public Contracts Code (D.Lgs. 36/2023, as amended by D.Lgs. 209/2024) makes digital information management mandatory for the design and construction of new works and interventions on existing works when the estimated cost of the works exceeds €2 million.

For listed heritage buildings the threshold rises to the EU works threshold. Ordinary and extraordinary maintenance is excluded, unless the asset was delivered with BIM, and so are purely immaterial interventions. The transitional rule in article 225-bis excludes some procedures already started by 31 December 2024.

The tool applies the Code, Annex I.9 and the MIT guidelines of February 2026, and returns the outcome with legal references, the documents to provide for and the prerequisites for the contracting authority.
